主讲人简介：

Gail Osherenko教授在加州大学戴维斯分校获得法律博士学位。现任职于美国加州大学圣巴巴拉分校。其主要研究兴趣为海岸带和海洋法律政策以及北极地区的环境保护等，出版著作和论文30余篇，包括在Science发表的Resolving Mismatchs in US Ocean Governance等。

Who Owns the Oceans?

The talk focuses on whether governments may privatize ocean space by granting exclusive rights to certain areas for fishing, extraction of ocean resources, or use of ocean space (e.g. for an offshore floating LNG terminal).  How does ownership in the sea differ from ownership on land?  What rights do governments have to allocate ocean space? New uses in the sea, such as deepsea vent mining, tidal energy, and offshore aquaculture, increase pressure for privatization of the seas. We need to understand the legal framework within which these new uses may operate.  They need security of investment.  The central argument is that governments may provide that security through contracts (through leases, concessions, or other legal instruments that protect the public interest and the environment). But governments may not legally privatize ocean space.
